New Jersey Expands Family Leave Protections Under NJFLA
Effective beginning on or about July 17, 2026
New Jersey has enacted a significant expansion of the New Jersey Family Leave Act (NJFLA). The amendments broaden employee coverage, strengthen job protection provisions and more closely align NJFLA protections with the state’s paid family leave benefits. As a result, fewer gaps will exist where employees receive wage replacement without guaranteed job protection.
These changes mean more employees will qualify for protected leave, and employers will face fewer situations where paid leave and job protection operate on separate tracks.
What This Means for Employers
Employers should begin reviewing leave policies now to ensure alignment with the expanded NJFLA requirements well ahead of the effective date. Coordination between federal Family and Medical Leave Act obligations, New Jersey leave protections and employer provided benefits should also be reassessed. Manager training is critical, as eligibility and reinstatement errors at the start of a leave often create the greatest compliance risk.
Proactive preparation will help minimize disruption and reduce exposure as these changes take effect.
